'Caveman' blogger fights for free speech

CHARLOTTE -- A North Carolina man is going to Federal court to fight for his right to openly talk and recommend his diet to others.

Steve Cooksey is a so-called "Caveman Blogger." After being diagnosed with diabetes in 2009, Cooksey adopted a Paleolithic diet.

"I was told I would likely be on drugs and insulin for the rest of my life," said Cooksey. "I realized the carb up and shoot up diabetes treatment program was a failure."

Now, he basically eats meats and vegetables. It's helped him lose 72 pounds and no longer need the use of insulin. Cooksey started the website www.diabetes-warrior.net to tell others about his diet. That all changed in January.

"The North Carolina State Board of Dietetics and Nutrition sent our client a 19-page copy of his online writings with a red pen indicating on a line-by-line basis what he can or cannot say. That's censorship," said attorney Jeff Rose with the Institute for Justice. "That violates the First Amendment."


The group filed a lawsuit Wednesday to allow Cooksey to continue his blog.

The board would not comment on the lawsuit, but did put up a lengthy explanation on its website. The group argues a license is required to provide nutrition care services or to help plan someone's diet.

"No one is saying the government can't regulate expert medical advice, but what Steve is suggesting is what people should buy at the grocery store," said Paul Sherman, with the Institute for Justice.

The group brought a buffet of Paleolithic food to the courthouse Wednesday to showcase the diet.

"There are a lot of people following a Paleolithic meal plan," said Cooksey.

He credits the diet for his healthier lifestyle.
