CHARLOTTE – The Charlotte-Mecklenburg Police Department is investigating a deadly officer-involved shooting that took place in north Charlotte. It happened on Crestview Drive just after 11:00 p.m. Monday.

Carolyn Faulkner watched the scene where a CMPD officer shot and killed her neighbor, 28-year-old Michael Laney.

"My heart is aching right now for our neighborhood because we're trying to build it back up, and for something devastating like this to happen, we don't know which way to go now," said Faulkner.

In a news conference Tuesday morning, CMPD Chief Rodney Monroe, says when two patrol officers spotted the red scooter Laney was driving, which fit the vehicle description from last week's armed robbery, they attempted a traffic stop, but Laney didn't pull over. After leading them to his front yard, Officer Ryan Shields attempted arrest him. Officers say Laney produced a gun, and there was a struggle for that weapon.

"Officer Shields called for help. Officer Holzhauer, who was arriving on the scene, responded up to help him during that struggle, at which time both officers, in fear of their lives, officer Holzhauer discharged one round from his service weapon, striking Mr. Laney on the right side of his temple," said Monroe.

Laney died immediately.

"This is one of those unfortunate incidents that we never look to engage ourselves in. It's not something that serves the department, the family of the victim, or the community well,” said Monroe.

It's the second officer involved shooting in a week. Chief Monroe says going after these individuals who are wanted and might be armed, is a part of their job.

"It's one of the reasons we equip and train our officers to the best of their ability to be able to deal with these situations, and unfortunately, they don't always turn out the way we would like for them to,” said Monroe.

Chief Monroe says the firearm Monday night was a small caliber, but the weapon from last week's armed robbery was a shotgun. He said they're searching Laney's home for that firearm.

Officer Anthony Holzhauer has been with CMPD since January, 2010. He has been put on administrative leave, which is standard procedure.
