CHARLOTTE — Demetrius Montgomery's murder trial began the week with the defendant refusing to come to court.

Similar delays continued for the first five days. On Tuesday, a judge ruled Montgomery can not be sentenced to death if he's convicted, because a detective in the case destroyed original case notes. Jury selection began Wednesday, but ended early Friday because both counsels needed more time to look into "certain matters".

Court is set to resume Monday morning.
