Montgomery murder trial in recess until Monday

CHARLOTTE -- The first few days of the Demetrius Montgomery murder trial were marred with delays and Friday was no different as the judge postponed proceedings through the weekend.

Montgomery is charged with killing Charlotte-Mecklenburg police officers Sean Clark and Jeff Shelton in 2007.

After meeting with both the prosecution and defense before court, Judge Bridges ruled that both sides needed more time to look into “certain matters.” The judge expects a full report Monday then will make the decision on how to proceed from there.

News 14 Carolina asked the lead prosecutor if she expected the case to resume as normal Monday and she replied, “I don’t know.”

If all goes as scheduled, jury selection will resume Monday. It began Wednesday and since then, numerous potential jurors were dismissed, most for having formed an opinion on the case from following in the news the last three years.

On Tuesday, the judge took the death penalty out of play after it was learned a detective in the case destroyed some of his notes from the investigation. Arvin Fant said he did that after rewriting the notes for neatness. He is now under investigation.

Montgomery, on several occasions, has delayed the trial proceedings by refusing to change from his orange jumpsuit. The only day he made it to court in dress clothes and a tie was Wednesday, the day after the death penalty was dropped.
