Officer shoots robbery suspect at Wendy's

CHARLOTTE -- A Charlotte-Mecklenburg police officer shot a robbery suspect early Friday morning. Police say Zavier Marquis Davis, 25, was trying to get away from a Wendy's on Park Road in south Charlotte. A second suspect is also in custody.
Police say Davis was armed with a handgun and was confronted by an officer as he tried to slip out the back door. The suspect was shot at least one time, hit in the left thigh and transported to Carolinas Medical Center with nonlife threatening injuries.
A manager called 911 around 1:30 a.m., and reported a robbery in progress. The first officer to arrive, Orville Payne, III., and confronted one suspect trying to leave out of the back of the restaurant. That's when at least one shot was fired, hitting the suspect. Police say the other suspect cooperated and went to headquarters for questioning.
No employees were hurt during the robbery or shooting. They were also taken to CMPD for questioning.
"We've been able to recover the money that was stolen from the business, as well as the firearm he was in possession of," said Chief Rodney Monroe. "[The] subject is at the hospital."
Payne was hired in September of 2009, assigned to the Westover Division. He is on administrative leave with pay, as with every officer involved shooting. There are two investigations now, one into the robbery and one by internal affairs into the shooting.
Davis has been charged with two counts of robbery with a dangerous weapon, four counts of kidnapping, and one count of possession of firearm by felon.
He has several prior convictions for robbery with a dangerous weapon and was released from jail in February.
This latest incident marks the third officer-involved shooting in Charlotte this month.
