Accused wife won't face death penalty

MOORESVILLE, N.C. – A Mooresville woman accused of killing her husband will not face the death penalty.

Quinn Witherspoon, a Concord police officer, was fatally shot in September by his own .40-caliber service weapon. His wife, Misty, originally told police she accidentally dropped the gun, causing it to discharge.

Police say she “began to crack” after days of questioning, providing them with enough information to believe the shooting was not an accident. Police have not yet revealed a motive for the shooting.

Witherspoon is being held in the Iredell County Jail without bond.
