CHARLOTTE -- For Keith Smith, the January day in which his fiance Danielle Watson was laid to rest, was supposed to be their wedding day.

"It's been a really, really rough few months,” Smith said.

In January, Watson's body was found stabbed to death in a dumpster near the Flying Biscuit Cafe, where the accused killer, 22-year-old Mark Anthony Cox, and the victim worked.

Authorities said Cox later told his sister he committed the crime, and police recovered what's believed to be the murder weapon.

On Thursday, Smith and Cox were face to face in a Mecklenburg County courtroom.

"It's very numbing to sit there,” Smith said.

Prosecutors announced they are seeking the death penalty for Cox if he's convicted for the murder of Watson and her unborn child.

For Smith, the development was bittersweet.

"I am happy that they want to go with the full extent of the law and i think that's what should happen, but at the same time, no matter what happens, we don't get Danielle back, we don't get our child back," Smith said.

If convicted, Cox would also be the first subjected to "Ethan's Law," which allows prosecutors to seek another murder indictment if the victim was pregnant.

Cox's attorney didn't have a comment after the appearance.

When asked in court, the prosecution wouldn't comment on what aggravating factors led them to pursue the death penalty for Cox.
