Witness near crime scene testifies in Montgomery trial

CHARLOTTE – On the second day of testimony in the Demetrius Montgomery murder trial, the prosecution worked Wednesday to put the defendant at the scene of the crime days, hours and minutes before the shootings of Charlotte-Mecklenburg police officers Sean Clark and Jeff Shelton.
An expert from a video monitoring company that had surveillance of a nearby convenience store was called to testify and a CMPD analyst and crime scene investigator helped to pinpoint the location of the crime scene at the Timber Ridge Apartments and the murder weapon.
Late Thursday afternoon, the state called a witness, a resident at the complex, who, so far, is the closest person to an eyewitness in the case.
Evelyn Tejada took the stand as the state's 12th witness. She described a short man wearing a white T-shirt and dark pants sitting on the steps of a nearby apartment.
She told the jury how the man was talking to police when she turned away, and the next thing she remembered was four to five gunshots. The witness never identified Demetrius Montgomery or saw anyone running from the scene.
Tejada broke into tears when describing the officers -- one lying on his back and the other on his side -- with blood coming from the side of his head. She described the chaotic moments afterward with neighbors screaming and others calling 911.
Tejada told the jury the officers guns were still in their holsters.
The defense questioned Tejada about her statements, asking if they were hers or accounts from others. They also attempted to raise doubt as to whether Montgomery was even there the night the officers were killed.
The proceedings got off to a slow start as questions arose about a juror's residency. One of the jurors moved out of Mecklenburg County since being seated. After looking into the issue, attorneys from both the prosecution and defense said they would like to continue with the trial and keep that juror.
